Hit and Runs Under Virginia Law


The law in Virginia looks at whether the accident involved only unattended property, such as a parked car or a fence, or attended property, such as an occupied vehicle. An accident will be considered a hit and run if:

  • You do not check on any other people involved in the accident
  • You do not attempt to contact the owner of the car or other property that you hit; and
  • You fail to notify police within 24 hours of the accident


Potential punishments differ depending on the type of accident, whether the other car’s occupants were injured and whether the amount of damage exceeds $1,000. It may be possible to be charged with a Class 5 felony, which carries up to 10 years in prison and $2,500 in fines. Less severe accidents still carry up to one year in jail, heavy fines and suspension of your driver’s license.
